What punishment do you want to give to a Rapist? Either a 7-year long jail term or an extreme punishment of Castration? With the incidents of rape increasing day by day in our country, is this 7 year jail term is sufficient or should we support the suggestion of Justice Kamini Lau for an alternative punishment castration of rapists?
A Thomson Reuters Foundation global poll reveals a shocking fact that India is the fourth most dangerous place in the world for women and the main reasons for such low scoring were female foeticide, infanticide and human trafficking. It is an irony for a country where first person of the country is a woman, President Pratibha Patil. More over four major states in India, Tamil Nadu, Uttar Pradesh, Delhi and West Bengal are ruled by women chief ministers J Jayalalitha, Mayawati, Sheila Dikshit and Mamata Banerjee respectively. In addition to this, the ruling congress chief (Sonia Gandhi) and the leader of opposition in the Lok Sabha (Sushma Swaraj) also women.
Justice Lau expressed her dismay over the absence of a law allowing courts to punish rapists and molesters with castration.Castration of Rapist is an idea that has been stirring the conscience of lawmakers and upsetting human rights activists around the world. The comments of Additional Sessions Judge Kamini Lau while awarding a 10-year prison term to Dinesh Yadav, who had repeatedly raped his 15-year-old stepdaughter shouldn’t be ignored.
“My hands are tied since I am bound by the law of the land,” Lau said in her judgment. “My conscience, however, tells me that this is a crime which is required to be addressed differently and a full public debate with regard to the imposition of castration (both surgical and chemical) as an alternative punishment for the offence of rape and molestation is the crying need of the hour,” she added.
The judgment cites examples of surgical and chemical castration as a punishment provided under the law in several developed countries.
What is Castration?
Castration is any action,surgical, chemical, or otherwise, by which a male loses the functions of the testicles or a female loses the functions of the ovaries. It can be surgical castration or chemical castration.
Since it is targeting men, castration means a man loses the functions of his testicles which is to produce the testosterone that has been linked with the aggressive and violent behaviour in men.
What is Surgical Castration?
It is a process of removing a man’s testes through a surgery. Surgical castration is not reversible but can retrieve the lost sex drive through synthetic testosterone.
What is Chemical Castration?
Chemical Castration is done by administration of drug to reduce or stop the production of testosterone. The drug is given in the form of injection and will have the effect only for 3 months. It is reversible. If the drug stopped, virility will be increased. It is done with the hope of preventing rapists, child molesters and other sex offenders from repeating their crimes.
Chemical castration is done to reduce libido and sexual activities. It has its own side effects like serious allergy reactions and blood-clots as well as user may experience feminising effects like enlarged breasts, reduced body hair and loss of muscle mass.
In many countries like US, UK, Germany and Israel, castration is a recognised punishment for child rapist and many other developed countries use it as a condition for probation. But in India, the existing law of the land is not permitting for a punishment like castration of rapist.
What is Rape?
Rape is a type of sexual assault usually involving sexual intercourse, which is initiated by one or more persons against another person without that person’s consent. In simple words, rape is a forced unwanted sexual intercourse.
Why the rapist should be castrated?
India is gone faraway in case of rape. At least one woman is getting raped in every 18 hrs in India. The ramification of the act is carried by the victim and her family throughout the life time. More than a physical attack, the dignity of a woman is getting hurt through rape. Most of the time, rape is about power of man and not sex. The present law of 7 years jail term is not sufficient to punish the rapist. Once the rapist is punished for 7 years, he comes back from jail and take revenge on the victim again.
The Judge said it is time “we as a civil society stand up and think of a law similar to the one existing in many developed countries providing for surgical and chemical castration”. and called for a public discussion on this.
All the men are not rapist but it doesn’t mean that a rapist shouldn’t be punished severely. While considering the growing rate of rape in India, it is better to go for Surgical Castration as the best suitable punishment for a rapist. Once it is made into law, immediately execute the punishment of castration on one or two rapist and create an awareness among the other rapist that this is what they are going to get once they commit the crime.

It is high time to stop the casual approach of the government towards the rape cases and pass some laws to give strong punishment to the rapists. First of all the culprits shouldn’t be numbered 1,2,3…but each and every one involved in the crime to be treated equally while giving the punishment. Now the question is death penalty or the chemical castration? I strongly support the death penalty rather than the chemical castration of the rapists. Once it is implemented without any fail definitely, the so called sexually sick men will give a second thought before committing rapist since the cost for their is their life itself.
